The U.S. Department of Veteran's Affairs administers the Aid and Attendance Pension benefit program for many wartime veterans and their spouses. This pension provides financial assistance to wartime veterans who lack the funds necessary to pay for the care and assistance they need for routine activities and daily living. The pension not only pays for the veteran's care, but also his/her spouse's care and, if the veteran passes away, the surviving spouse's care.
A qualified veteran with a spouse can apply for financial assistance of up to $24,240 per year, tax-free. The veteran or spouse can use the Aid & Attendance Pension benefit to help pay for home health care, assistance living or nursing home care. In many cases, the Aid & Attendance Pension, along with other monthly income or family subsidies, has made it possible for residents to avoid going on Medicaid and remain in their own homes or private-pay assisted living homes.
Jim Underhill, the founder and president of Neighborhood Law Office, is a veteran himself, was stationed in Korea and served with the U.S. Army Judge Advocate General's Corps. Neighborhood Law Office provides free screening and determinations to the public in conjunction with Underhill & Underhill, P.C. The application for the pension is actually prepared by Underhill & Underhill, P.C., a separate law firm in which Jim Underhill is a principal, and if a pension is applied for, NLO will share the fee for preparation of the application with the Underhill & Underhill, P.C. The applications are prepared by former employees of the Dept. of Veterans Affairs and trained paralegals. However, although 2 firms may be involved, no one pays more than the standard rate.
NO FEE may ever be charged to, or paid by, a veteran or the veteran's spouse -- That is Federal Law. All fees to the law firms must be paid by third parties, usually a child or relative who is involved in caring for the veteran or the veteran's spouse. The fee paid is for the preparation of the application. No fee is charged if the application cannot be filed because the veteran or spouse does not qualify.
