Can I Claim An Extended Family Member As A Dependent On The Means Test for Bankruptcy?
My mother is in Mexico. I supply more than half her support, and I take her as a dependent on my US federal income tax return. Can I claim her as a dependent in my bankruptcy in order to qualify under the Means Test? [Los Angeles, California]
Answer:
Yes, but you mother is not listed as a dependent in bankruptcy. While her mother is not a dependent on the means test form, she IS a "person for whom the filer provides support" and therefore is noted line 35 on the Form 22 of the Means Test for deduction of "Continued contributions to the care of ... family members".
